Terms of Service and Privacy Policy

Welcome to BookFort! These Terms of Service and Privacy Policy (collectively referred to as the "Agreement") govern your use of the BookFort website mobile application and any related services (collectively referred to as the "Platform"). By accessing or using the Platform you agree to be bound by these terms and conditions. If you do not agree with any part of this Agreement please refrain from accessing or using the Platform.
1.1 By accessing or using the Platform you represent and warrant that you are fully able and competent to enter into this Agreement and to abide by all of its terms and conditions.
1.2 If you are using the Platform on behalf of a company or organization you represent and warrant that you have the necessary authority to bind such entity to this Agreement.
2.1 In order to access certain features of the Platform you may be required to create an account. You agree to provide accurate up-to-date and complete information during the registration process.
2.2 You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for any activity that occurs under your account.
2.3 You agree to notify BookFort immediately of any unauthorized use of your account or any other breach of security.
3.1 BookFort respects intellectual property rights and expects its users to do the same. You retain ownership of any content you submit post or display on the Platform.
3.2 By posting or uploading content on the Platform you grant BookFort a non-exclusive worldwide royalty-free sublicensable and transferable license to use reproduce modify adapt publish translate distribute publicly perform and display such content.
4.1 All intellectual property rights in the Platform (including but not limited to text graphics logos icons images audio clips digital downloads and software) are owned by BookFort or its licensors.
4.2 Users are prohibited from using reproducing distributing or modifying any intellectual property material without obtaining prior written consent from BookFort.
5.1 Users agree not to engage in any conduct that violates applicable laws infringes upon the rights of others or disrupts the Platform's operation.
5.2 Prohibited conduct includes but is not limited to the following:
a) Posting or transmitting any content that is unlawful harmful defamatory obscene or infringing;
b) Impersonating any person or entity;
c) Engaging in any unauthorized commercial activities on the Platform;
d) Interfering with or disrupting the Platform's functionality;
e) Attempting to gain unauthorized access to any part of the Platform;
f) Collecting or tracking the personal information of others without their consent;
g) Uploading or transmitting any viruses worms or other malicious code.
6.1 The Platform may contain links to third-party websites or resources. BookFort is not responsible for the availability accuracy or content of such external sites or resources.
6.2 BookFort does not endorse any third-party content products services or information and you acknowledge and agree that BookFort shall not be responsible or liable directly or indirectly for any loss or damage caused or alleged to be caused by or in connection with the use of any such content or resources.
7.1 BookFort may at its sole discretion terminate or suspend your access to the Platform without prior notice for any reason including but not limited to violation of this Agreement or applicable laws.
7.2 Upon termination all licenses and rights granted to you under this Agreement will immediately cease and you must cease all use of the Platform.
8.1 The Platform is provided on an "as is" and "as available" basis. BookFort makes no representations or warranties of any kind whether express or implied including but not limited to warranties of merchantability fitness for a particular purpose or non-infringement.
8.2 BookFort does not warrant that the Platform will be uninterrupted error-free or secure or that any defects or errors will be corrected.
9.1 To the extent permitted by applicable law BookFort shall not be liable for any direct indirect incidental special consequential or exemplary damages including but not limited to damages for loss of profits goodwill use data or other intangible losses arising out of or in connection with your use of the Platform.
.9.2 BookFort's total liability to you for any claim arising out of or in connection with this Agreement shall not exceed the total fees paid by you if any to BookFort in the twelve months prior to the claim.
10.1 You agree to indemnify defend and hold BookFort harmless from and against any losses liabilities claims demands damages costs and expenses including reasonable attorneys' fees arising out of or in connection with your use of the Platform or any violation of this Agreement.
11.1 BookFort reserves the right to modify or update this Agreement at any time. Any changes made will be effective immediately upon posting to the Platform.
12.1 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any dispute arising under this Agreement shall be submitted to arbitration in accordance with the rules of [Arbitration Institution] before resorting to any court proceedings.
13.1 This Agreement constitutes the entire understanding between you and BookFort regarding the use of the Platform superseding any prior agreements or understandings.
14.1 If any provision of this Agreement is held to be invalid or unenforceable the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
